We REINSTATE this appeal.
We abated this appeal on October 1, 2024, for the trial court to hold a hearing within twenty days and to file within thirty days findings concerning whether there was a reported hearing on February 13, 2023.
Before the Court is the parties' October 15, 2024 joint motion to extend the time for the trial court to hold a hearing concerning whether there was a reported hearing on February 13, 2023. Counsel for appellant states that the transcription of the hearing was attached to the State's motion for recusal, and the parties have requested the district clerk to file a supplemental clerk's record containing exhibits attached to the State's motion for recusal. Counsel for appellant states that if the parties are successful, there will be no need for the hearing required by the order of October 1, 2024.
We GRANT the motion to the extent that we VACATE the order of October 1, 2024. The trial court need not hold the hearing or make the findings required by that order.
We ORDER the district clerk to file a supplemental clerk's record containing the exhibits attached to the March 21, 2023 State's Amended Motion to Recuse the Honorable Judge Amber Givens on or before NOVEMBER 1, 2024.
We DIRECT the Clerk to send copies of this order to the Honorable Nancy Mulder, Presiding Judge, Criminal District Court No. 6, Dallas County; Felicia Pitre, Dallas County District Clerk; Marissa Garza, Official Court Reporter, Criminal District Court No. 6; Sharyl Zeno, Official Court Reporter, Criminal District Court No. 1; Lisa Jackson, Official Court Reporter, 282nd District Court; and counsel for all parties.
