DWJ v. CB

LC No. 22-108559-PH

ORDER

Christopher M. Murray, Judge, acting under MCR 7.211(E)(2), orders:

The motion for reconsideration is DENIED. The documentation provided by appellant clearly states that appellant "meet[s] all of the requirements to receive Medicaid except income." (Emphasis added.) The document goes on to explain that if appellant incurs medical expenses above his deductible amount of $6,288 each month, he would then become eligible for Medicaid coverage. Or, if appellant's circumstances change, "such as changes to income, assets or family size[,]" he might become eligible for Medicaid coverage. Appellant has provided no evidence that he satisfied his deductible or that his circumstances changed such that he is receiving Medicaid benefits. In other words, and while appellant may be enrolled in Medicaid because of disability or other circumstances unrelated to indigence, he has provided nothing demonstrating that he "is receiving any form of means-tested public assistance ...." MCR 2.002(C) (emphasis added). Appellant's affidavit of indigency shows that he is gainfully employed and receives income far in excess of 125% of the federal poverty guidelines. See MCR 2.002(F). As appellant has not otherwise established that paying this Court's fees would constitute a financial hardship, MCR 2.002(F), he is not entitled to a fee waiver.
