This matter is before the court on Defendants' Motion to Dismiss. A hearing on that motions was held on June 7, 2000. At the hearing, Defendants were represented by Dale J. Larmbert, and Plaintiffs were represented by Kathryn Collard. Before the hearing, the court considered carefully the memoranda and other materials submitted by the parties. Since taking the matter under advisement, the court has further considered the facts relating to this motion. Now being fully advised, the court renders the following Order.

IT IS HEREBY ORDERED that Defendants' Motion to Dismiss is DENIED. In addition, the above — stated matter is consolidated with the cases of Durrant et, al., v. Jess Green at at, Case No. 2:96CV679ST and Dutson et.al. v. City of American Fork et al., Case No. 2:00CV24K, These matters are consolidated on the basis that they involve the same core facts. Consolidation of these matters preserves judicial efficiency and promotes the convenience of the parties and witnesses. All further proceedings in this case shall be captioned under Case No. 2:96CV679ST,
