Durkin v. Costa Armatori

District Court of Appeal of Florida, Third District
Feb 4, 1986
481 So. 2d 506 (Fla. Dist. Ct. App. 1986)

Opinion

No. 85-1317.

December 17, 1985. Rehearing Denied February 4, 1986.

Appeal from a non-final order of the Circuit Court, Dade County; John A. Tanksley, Judge.

Dennis G. King, Miami, for appellants.

Holland Knight and Michael T. Moore and George Mencio, Jr., Miami, for appellee.

Before SCHWARTZ, C.J., and NESBITT and JORGENSON, JJ.

The issue presented in this appeal is precisely the same as that considered by the Fifth Circuit in Hoffman v. Air India, 393 F.2d 507 (5th Cir. 1968). See also Dombroff v. Eagle-Picher Industries, Inc., 450 So.2d 923 (Fla. 3d DCA), rev. denied, 458 So.2d 272 (Fla. 1984). Accordingly, we reverse the trial court's order dismissing the Durkins' amended complaint for lack of in personam jurisdiction and remand for further proceedings.

Reversed and remanded for further proceedings.
