ORDER

Lewis R. Carluzzo, Chief Special Trial Judge.

This I.R.C. section 6330(d) case, presently set for trial during the Dallas, Texas, trial session scheduled to begin on October 30, 2023, in that city, is before the Court on respondent's (1) motion to dismiss, and (2) motion for continuance, both filed September 29, 2023. Giving due regard to the representations contained in the motions, it is

ORDERED that the motions are set for hearing at the time, date and place shown in the Notice Setting Case for Trial served June 13, 2023. It is further

ORDERED that the parties are excused from complying with the terms and conditions set forth in the Standing Pretrial Order served June 13, 2023.

The Court is inclined to grant both motions. The hearing will address the future actions the parties intend to take to (1) resolve a procedural issue, and (2) prepare for trial or resolve the case without the need for trial.
