Dupree v. Schwarzkophf

Supreme Court of Georgia
Jul 5, 2011
S11A0290 (Ga. Jul. 5, 2011)

Opinion

S11A0290

DECIDED: JULY 5, 2011

The Honorable Supreme Court met pursuant to adjournment. The following order was passed.

On June 27, 2011, the Court issued an opinion affirming the habeas court's order denying Dupree's habeas petition, which sought his unconditional release from involuntary inpatient treatment for mental illness originally imposed based on findings that he was not guilty by reason of insanity of several crimes. The Court has since been advised that on February 18, 2011, the committing criminal court granted Dupree unconditional and full release from involuntary treatment. Because Dupree obtained the relief he sought in his habeas action, this appeal was rendered moot before our opinion was issued. It is therefore ordered that the opinion in this case be vacated and this appeal be dismissed.
