Duplantis v. Terrebonne Parish School Board

Supreme Court of Louisiana
Mar 9, 1976
328 So. 2d 374 (La. 1976)

Opinion

No. 57597.

March 9, 1976.

In re: J. G. Duplantis, applying for writs of Certiorari.

Writ refused. The judgment of the district court is correct. The trial judge correctly held that the rate and use limitations in L.S.A.-R.S. 33:2737 are inapplicable to sales taxes levied under Article 6, Section 29 of the Constitution of 1974.

SUMMERS and CALOGERO, JJ., are of the opinion the writ should be granted.
