Dunnaway v. State

District Court of Appeal of Florida, Fourth District
Aug 8, 1990
564 So. 2d 646 (Fla. Dist. Ct. App. 1990)

Opinion

No. 88-1696.

August 8, 1990.

Appeal from the Circuit Court for Palm Beach County; Don T. Adams, Judge.

Richard L. Jorandby, Public Defender, and Anthony Calvello, Asst. Public Defender, West Palm Beach, for appellant.

Robert A. Butterworth, Atty. Gen., Tallahassee, and Sylvia H. Alonso, Asst. Atty. Gen., West Palm Beach, for appellee.

The state concedes the trial court erroneously scored the primary offense as a life felony instead of a first-degree felony punishable by life. Accordingly, we remand with direction to correct the sentencing guideline scoresheet with the proper score.

GLICKSTEIN, GUNTHER and STONE, JJ., concur.
