Opinion

CASE NO.: 2D19-4645

01-28-2020

Chaz M. DUNLAP, Appellant/Petitioner(s), v. STATE of Florida, Appellee/Respondent(s).

BY ORDER OF THE COURT:

The petition for writ of mandamus is denied without prejudice to the appellant to file a new petition after waiting a reasonable time following the most recent filing of the petitioner's postconviction motion, which appears to have been docketed in the circuit court on December 5, 2019. The court notes that the online docket in circuit court case 13-CF-017255 shows no filings after the judgment and sentence entered on July 10, 2014, until the December 5, 2019, filing. The petitioner's motion to hear and rule was docketed on December 23, 2019, and a motion for accelerated hearing on January 13, 2020.
