Opinion
Gen. No. 41,337. (Abstract of Decision.)
Opinion filed December 30, 1940
AUTOMOBILES AND MOTOR VEHICLES, § 128 — intending bus passenger struck by automobile, evidence. Plaintiff who was struck by defendant's automobile as he was boarding a bus was erroneously granted judgment below, as evidence showed that defendant was traveling west with a green light in her favor, and that as the bus which had been traveling west started to make a left turn, plaintiff leaped from the sidewalk in front of defendant's car, in an attempt to catch the bus; $2,500 verdict for loss of a young man's leg was so inadequate as to show that it was a sympathy verdict, not predicated upon the evidence.
