In Duarte v. State of California, 88 Cal.App.3d 473 (Cal.Ct.App. 1979), the mother of a student raped and murdered in a state university dormitory was allowed to bring a claim for negligent misrepresentation, where the mother alleged that she relied on the university's assertion that their dormitories were safe when she chose to house her daughter there instead of a private residence.
