This case is calendared on the Court's January 22, 2024, New York, New York, trial session. On December 20, 2023, petitioner filed a Motion for Continuance, requesting that this case be stricken from the New York trial session and restored to the general trial docket. On January 2, 2024, the parties filed a Stipulation of Settlement, representing that they have reached a basis of settlement concerning all remaining issues. On January 5, 2024, respondent filed a Response to the Motion in which he represents that the parties intend to file a proposed stipulated decision before the scheduled trial.

In consideration of the foregoing, it is

ORDERED that petitioner's Motion for Continuance, filed December 20, 2023, is denied as moot. The Court expects that the parties will submit decision documents at the January 22, 2024, calendar call, if not sooner.
