Based on the reasoning and citations of authority set forth in the United States Magistrate Judge's Report and Recommendation (Doc. #43), issued February 25, 2013, as well as upon a thorough de novo review of this Court's file and the applicable law, this Court ADOPTS said judicial filing in its entirety, and OVERRULES Plaintiff's Objections thereto (Doc. #44).
The Court SUSTAINS Defendant's Motion for Order Certifying that Appeal is Not Taken in Good Faith. Doc. #42. Plaintiff is therefore denied the right to proceed in forma pauperis on appeal. Pursuant to Federal Rule of Appellate Procedure 24(a)(4)(B), the Clerk of Court shall so notify the Sixth Circuit Court of Appeals.
