This case is set for hearing on the Commissioner's Motion to Dismiss for Lack of Jurisdiction filed July 26, 2022, at the Court's October 17, 2022, San Francisco trial session at a time and date certain of 1:00 pm on October 19, 2022. On October 11, 2022, the Court held a conference call with the parties. During that call, counsel for Mr. Drew explained petitioner located a complete copy of the notice of deficiency that the Commissioner issued to him. Accordingly, counsel for Mr. Drew anticipates filing a supplement to petitioner's opposition to the Commissioner's motion to dismiss in which he will withdraw petitioner's objection to the motion. Relying on the representations made on that call, it is

ORDERED that the Court's Order served on September 29, 2022, is vacated. It is further

ORDERED that the Commissioner's Motion to Dismiss for Lack of Jurisdiction filed July 26, 2022, is taken under advisement. It is further

ORDERED that this case is stricken from the above-referenced trial session. It is further

ORDERED that jurisdiction of this case is retained by the undersigned.
