This case is currently calendar for trial at the Court's April 11, 2023, Detroit, Michigan trial session. On January 13, 2023, respondent filed a Motion to Dismiss for Lack of Prosecution moving to dismiss the case as to the deceased petitioner Terry L. Drennan. In the motion, respondent states that the surviving spouse, Sharon K. Drennan, does not object to the granting of the motion to dismiss and a copy of the death certificate is attached to the motion. Upon due consideration, it is

ORDERED that respondent's Motion to Dismiss for Lack of Prosecution, as moves to dismiss petitioner Terry L. Drennan, is granted, and this case is dismissed for lack of prosecution as to Terry L. Drennan. It is further

ORDERED that the caption in this case is changed to read "Terry L. Drennan, Deceased, and Sharon K. Drennan, Petitioners v. Commissioner of Internal Revenue, Respondent."

The parties are reminded that this case remains calendared for trial at the Court's April 11, 2023, Detroit Michigan trial session.
