Drapes v. Ellis 1st Natl. Bank

District Court of Appeal of Florida, Second District
May 23, 1986
488 So. 2d 910 (Fla. Dist. Ct. App. 1986)

Opinion

No. 85-1997.

May 23, 1986.

Appeal from the Circuit Court for Pinellas County; William L. Walker, Judge.

Robert G. Leeds of Quesada Leeds, P.A., Clearwater, and Steven H. Mezer of Mezer Kipp, P.A., Clearwater, for appellant.

Joline Micele-Mullen of Blalock, Coleman, Landers Walters, P.A., Bradenton, for appellee Ellis First Nat. Bank of West Pasco.

We construe the final judgment of foreclosure in favor of appellee Ellis First National Bank as not affecting the furniture, drapes and cooking utensils which are described in the trial court's order of April 12, 1984, and are subject to the lien claimed by appellant Drapes by Janice, Inc. Hence, any sale of these items under such judgment would be void.

As construed, the final judgment is affirmed.

GRIMES, A.C.J., and SCHEB and SCHOONOVER, JJ., concur.
