Drakulich v. Hurley

Appellate Court of Illinois, First District
Mar 16, 1949
337 Ill. App. 102 (Ill. App. Ct. 1949)

Opinion

Gen. No. 44,620. (Abstract of Decision.)

Opinion filed March 16, 1949 Released for publication April 11, 1949

OFFICERS AND PUBLIC EMPLOYEES, § 67.1review of findings of Civil Service Commission. Evidence appearing in Chicago Civil Service Commission's record, upon which plaintiff was discharged from police department, tending to prove charges that plaintiff had solicited a bribe from a speeder in exchange for freedom from arrest and punishment was sufficient to establish jurisdictional fact of "cause" giving commission power to make its finding and decision discharging plaintiff; hence commission's finding and decision would not be disturbed in certiorari proceedings where charges against plaintiff were written and he had appeared with counsel and made a defense (Ill. Rev. Stat. 1947, ch. 24 1/2, par. 51; Jones Ill. Stats. Ann. 23.052).
