Granted. The judgment of the court of appeal is reversed, and the motion for summary judgment is denied. See Steptoe v. Lallie Kemp Regional Hosp., 634 So.2d 331 (La. 1994). The case is remanded to the district court for further proceedings.

CALOGERO, C.J., not on panel.

LEMMON, J., concurs. Because this court is reversing a summary judgment, the malpractice defendants will have the opportunity on remand to plead and prove proportionate fault on the part of Piccadily.
