    In State v. Simons (Nov. 22, 2000), Champaign App. No. 99CA5, 2000 WL 1726904, the defendant moved to dismiss his appointed counsel and identified the reason for the request as a conflict of interest.

    As this court has previously noted, "the Supreme Court of Ohio has long held that the failure to provide a preliminary hearing within the proscribed time limits of [R.C.] 2945.71 is not fatal to a subsequent indictment for the same offense." State v. Downs (July 25, 1997), Miami App. No. 96 CA 54, unreported, citation omitted. Therefore, the First Assignment of Error is overruled.
