STIPULATED ORDER GRANTING JOINT MOTION TO VACATE JUDGMENT, CANCEL BOND, RELEASE FUNDS, DISMISS COURT ACTION AND APPEAL WITH PREJUDICE AND WITHOUT COSTS
This matter having come before the Court upon the Joint Motion and Stipulation of the Parties as evidenced by the signature of counsel below, NOW, THEREFORE, in accordance with the Parties' Joint Motion and Stipulation:
IT IS HEREBY ORDERED AND DECREED that the Parties' Joint Motion is granted.
IT IS FURTHER ORDERED that upon presentation of this Order to the Escrow Agent, First American Title Insurance Co. ("Escrow Agent"), the Escrow Agent shall distribute the Escrow Funds in accordance with the Escrow Agreement.
IT IS FURTHER ORDERED the Judgment entered on January 21, 2022 in the above-entitled court action in the Wayne County Circuit Court Case No. 19-011350-CZ shall be and hereby is vacated and of no force or effect, upon payment to Plaintiff in accordance with the parties' Confidential Settlement Agreement, this Order, and the Escrow Agreement.
IT IS FURTHER ORDERED that this court action and appeal are dismissed with prejudice and without costs or attorney fees to either party.
