Angela D. Dowling-Perez v. Legacy at Cypress

Date motion filed: September 27, 2023

County Civil Court at Law No. 3 of Harris County No. 1200767

Panel consists of: Justices Kelly, Landau, and Farris.

ORDER ON MOTION FOR REHEARING

April Farris, Judge

In this forcible-detainer action, appellant, Angela D. Dowling-Perez, proceeding pro se, filed a notice of appeal from the judgment and writ of possess granting possession of certain real property to appellee, Legacy at Cypress. On September 26, 2023, the Court dismissed appellant's appeal as moot. See Dowling-Perez v. Legacy at Cypress, No. 01-23-00319-CV, 2023 WL 6219410, at *1 (Tex. App.-Houston [1st Dist.] Sept. 26, 2023, no pet. h.) (dismissing appeal as moot because "appeal from a forcible-detainer action becomes moot if the appellant is no longer in possession of the property").

On September 27, 2023, after her appeal was dismissed, appellant filed a "Motion for Perjury." Then, on September 29, 2023, appellant filed a "Motion for Contempt and Enforcement." While these motions were filed on different days and are titled differently, the text of the motions are identical.

We construe appellant's motions as motions for rehearing. See Tex. R. App. P. 49.1. It is ordered that appellant's motions for rehearing are denied.

It is so ORDERED.
