Dowgul v. Adair

District Court of Appeal of Florida, First District
Apr 28, 1978
357 So. 2d 791 (Fla. Dist. Ct. App. 1978)

Opinion

No. HH-213.

April 28, 1978.

Appeal from Circuit Court, Bay County; N. Russell Bower, Judge.

Carroll L. McCauley, Panama City, for appellant.

Clinton E. Foster, Panama City, for appellee.

This appeal is from a trial court's order dismissing appellant's petition for adoption at the conclusion of appellant's case. We have reviewed the record and concluded that the appellant did present a prima facie case of abandonment by the natural father. It was error to dismiss the petition; therefore the cause is remanded for further proceedings.

McCORD, C.J., and SMITH and MELVIN, JJ., concur.
