On September 2, 2003, Defendant J.C. Penney Company, Inc. filed a Motion for Summary Judgment. Plaintiff Sherry Lynn Douglas's opposition to Defendant's Motion was due no later than October 21, 2003. To date, Plaintiff has not filed any opposition papers with the court.

Having reviewed Defendant's Motion, the court finds it is meritorious. Accordingly, Defendant's Motion for Summary Judgment is GRANTED.

That judgment be entered in favor of the defendant; plaintiff's claims are dismissed.
