ON APPEAL FROM THE COUNTY COURT AT LAW NO. 3 OF NUECES COUNTY, TEXAS
Before Justices Benavides, Longoria, and Silva
ORDER OF ABATEMENT
PER CURIAM
This appeal is before the Court upon the court reporter's second request for extension of time to file the reporter's record. After we granted a first extension, the court reporter, Marisa Hinojosa, requested an extension until October 25, 2024, to file the reporter's record.
The Court has a responsibility to avoid delay and to preserve the parties' rights and may only extend the deadline to file the reporter's record by 30 days per extension. See Tex. R. App. P. 35.3(c), 37.3. However, in considering the court reporter's request and circumstances surrounding her ability to prepare the reporter's record, specifically the fact that she is currently on maternity leave, we are of the opinion that the timeline for submission of the reporter's record should be adjusted.
Accordingly, we hereby suspend the 30-day limit to the court reporter's current extension request. See id. R. 2. Accordingly, the court reporter's request for extension is granted, and the reporter's record is now due to be filed on or before October 25, 2024. Furthermore, this matter is abated pending the submission of the reporter's record and shall be reinstated upon completion of the appellate record and commencement of the briefing timeline. Notice of those events shall be issued accordingly.
