Dougherty v. Anderson

District Court of Appeal of Florida, Second District
Sep 19, 1980
388 So. 2d 49 (Fla. Dist. Ct. App. 1980)

Opinion

No. 80-873.

September 19, 1980.

Appeal from nonfinal order of Circuit Court, Pinellas County; Fred L. Bryson, Judge.

Robert E. Bugg of Marlow, Shofi, Ortmayer, Smith, Connell Valerius, Tampa, for appellants.

H. Shelton Philips of Kaleel Kaleel, P.A., St. Petersburg, for appellees.

Dougherty and his insurance company appeal from an order granting summary judgment as to liability in a rear-end collision case. The order does not address appellees' request for punitive damages. We construe the order as not granting liability for punitive damages. The order is affirmed as construed.

SCHEB, C.J., and HOBSON, J., concur.
