On Appeal from the 298th Judicial District Court Dallas County, Texas Trial Court Cause No. DC-17-09184
ORDER
BILL PEDERSEN, III JUSTICE
Before the Court is appellee's motion to reinstate this appeal, which we abated due to appellant's bankruptcy. Appellee asserts in the motion that appellant has been discharged from the bankruptcy proceeding. Although the motion has been on file for more than ten days, appellant has not responded.
We GRANT the motion and REINSTATE the appeal. As the appeal was abated before the clerk's record was filed, we ORDER Dallas County District Clerk Felicia Pitre to file the record no later than July 1, 2024.
We note that, before the appeal was abated, Jennifer Jacobs, Official Court Reporter for the 298th Judicial District Court, informed the Court that appellant had not requested the reporter's record. Accordingly, we ORDER appellant to file, no later than June 10, 2024, written verification he has requested the reporter's record and has paid, or made arrangements to pay, for the reporter's record. We caution appellant that failure to comply may result in the appeal being submitted without the reporter's record. See Tex. R. App. P. 37.3(c).
We DIRECT the Clerk of the Court to send a copy of this order to Ms. Pitre and the parties.
