This case is currently calendared on the Court's Denver, Colorado trial session, scheduled to begin April 24, 2023. On February 16, 2023, the Commissioner filed an unopposed motion to dismiss for lack of jurisdiction as to petitioner Henry W. Dornseif. We will grant the motion. Accordingly, it is

ORDERED that the Commissioner's motion to dismiss for lack of jurisdiction as to Henry W. Dornseif is granted, and that Henry W. Dornseif is dismissed for lack of jurisdiction. All references in the petition as it relates to Henry W. Dornseif are deemed stricken. It is further

ORDERED that the caption is amended to read, "Phyllis Dornseif, Petitioner v. Commissioner of Internal Revenue, Respondent."
