This case is calendared for trial at the Court's March 21, 2024, Wichita, Kansas, trial session. On January 17, 2024, respondent filed a Motion for Summary Judgment. Respondent moves, pursuant to Tax Court Rule 121, for summary judgment. Respondent alleges that he is entitled to judgment as a matter of law and that there is no genuine issue of material fact requiring a trial in this case. Upon due consideration and for cause, it is
