Donato v. Gritz

Appellate Division of the Supreme Court of New York, Second Department
Oct 26, 1984
104 A.D.2d 1025 (N.Y. App. Div. 1984)

Opinion

October 26, 1984

Appeal from the Supreme Court, Kings County (Lodato, J.).

Order affirmed, insofar as appealed from, without costs or disbursements.

Considering the totality of the circumstances, including the lack of demonstrable prejudice to defendants, we conclude that there is no basis to disqualify plaintiff's counsel (see Lopez v. Precision Papers, 99 A.D.2d 507). Brown, J.P., Niehoff, Rubin and Eiber, JJ., concur.
