ORDER

AND NOW, this 11th day of October, 2023, for the reasons set forth in the accompanying memorandum, it is hereby ORDERED that:

1. Petitioner's motion (Doc. 20) to lift the stay is GRANTED.
2. The Clerk of Court is directed to lift the stay in this matter and reopen the case.
3. The petition (Doc. 1) for writ of habeas corpus is DENIED with prejudice.
4. A certificate of appealability shall not issue.
5. The Clerk of Court is directed to terminate the Attorney General of Pennsylvania and the District Attorney of Lackawanna County, Pennsylvania as respondents in this action.
6. The Clerk of Court is directed to CLOSE this case.
