Appellant having moved for an extension of time to file and serve a reply brief on the appeal taken herein from an order of the Supreme Court entered in the Office of the Clerk of the County of Erie on September 10, 2013,

Now, upon reading and filing the affidavit of Jeanne M. Vinal, Esq., sworn to September 22, 2014, the affidavit of Gregory M. Vinal, Esq., sworn to October 3, 2014, the notice of motion with proof of service thereof, and the affirmation of Fallyn B. Cavalieri, Esq., dated October 2, 2014, and due deliberation having been had thereon,
