ORDER

Colleen A. O'Brien Presiding Judge

Pursuant to the March 8, 2024 order of the Michigan Supreme Court, we REMAND this case to the Small Claims Division of the Michigan Tax Tribunal (MTT). Within 28 days after the date of this order, the MTT shall file with this Court a written statement specifying "(1) whether the petitioner presented evidence in the form of videos and photographs at the May 6, 2021 hearing that purportedly show that the petitioner and his wife had moved out of the Old Colony property to the Lakeside property; (2) whether any such evidence presented was admitted for the MTT's consideration and, if not, the reason why it was not admitted; (3) whether any such evidence, if presented and admitted, was considered by the MTT in its final opinion and judgment, despite the lack of specific reference to said evidence therein; and (4) whether the respondent conceded during the hearing that the petitioner's evidence was sufficient to meet his burden of proof to claim the principal residency exemption." Doerr v Dep't of Treasury, Mich __; __ N.W.2d __ (March 8, 2024) The MTT shall also file with this Court all transcripts that it had pre ared of the hearings in this case, if any such transcripts have been prepared, within 28 days after the date of this order. If no such transcripts were prepared, the MTT shall file a written statement to that effect with this Court within 28 days after the date of this order. Thereafter, we will reconsider this appeal in light of this information as directed by our Supreme Court.

We retain jurisdiction.
