By order of March 27, 2001, this case was remanded to the Court of Appeals with the direction that the special panel address the issue of whether 1999 PA 201 should be applied retroactively to this case. On order of the Court, the opinion of the Court of Appeals special panel having been filed, the application for leave to appeal from the March 3, 2000, decision of the Court of Appeals is again considered, and it is DENIED because we are not persuaded that the questions presented should be reviewed by this Court.

Cavanagh, J., would grant leave to appeal.

Taylor, J., not participating.
