McClendon, J., dissents and is of the belief that after the Board pointed out the absence of factual support for one or more elements of Sally Dobyns' claim of harassment and she failed to produce factual support sufficient to establish that she would be able to satisfy her evidentiary burden of proof at trial, there is no genuine issue of material fact and the Board is entitled to summary judgment.
