MEMORANDUM OPINION


A jury found Jason Mark Dixon guilty of driving while intoxicated and assessed punishment at 180 days' confinement in jail, probated for one year, and a $2000 fine. See Tex. Pen. Code Ann. § 49.04 (Vernon 2003). We adopted a finding that appellant no longer desires to prosecute the appeal and submitted the appeal without briefs. See Tex.R.App.P. 38.8(b). Absent briefs, no points of error are before us. Finding no fundamental error, we affirm the trial court's judgment.
