VERNON KING DIXON, Appellant, v. THE STATE OF TEXAS, Appellee.

Do not publish. Tex.R.App.P. 47.2(b).

ON APPEAL FROM THE 187TH DISTRICT COURT OF BEXAR COUNTY, TEXAS.

Before Chief Contreras and Justices Tijerina and Peña

ORDER OF ABATEMENT AND ORDER TO FILE APPELLANT'S BRIEF

PER CURIAM

This cause is before the Court on appellant's amended third motion for extension of time to file appellant's brief. Appellant's brief was originally due on March 7, 2024. After two previous extensions, appellant's brief was due to be filed on June 14, 2024. On June 26, 2024, we granted a motion to supplement the reporter's record making the supplemental reporter's record due to be filed on or before July 26, 2024. Furthermore, we directed appellant to file his brief on or before thirty (30) days after the submission of the supplemental reporter's record.

The Court, having fully examined and considered the extensions previously granted in this cause, the status of the pending supplemental record, and current pending motion is of the opinion that the matter should be abated to allow adequate time to complete the record and appellant's brief. Accordingly, appellant's amended third motion for extension of time to file the brief is hereby granted in part and denied in part and the matter is abated pending appellant's brief. IT IS THEREFORE ORDERED that the Honorable H. Todd McCray, counsel for appellant, file appellant's brief with this Court on or before thirty (30) days after the supplemental reporter's record is received by the Court.
