ORDER


Before the court are the Findings, Conclusions and Recommendation of the United States Magistrate Judge ("Report"), filed March 23, 2004, to which no objections have been made. After reviewing the findings, the court determines them to be correct, and they are accepted as those of the court. Accordingly, for the reasons stated in the Report, this case is dismissed without prejudice for want of prosecution pursuant to Fed.R.Civ.P. 41(b).

The court also notes that on April 21, 2004, the Report was returned as undeliverable with the notation "refused," which further supports the conclusion that Plaintiff has abandoned this lawsuit.

It is so ordered.
