This case is before the Court on respondent's Motion to Dismiss for Lack of Prosecution filed January 14, 2022, at docket entry number 9. On January 21, 2022, the Court set respondent's motion for hearing at the Court's February 7, 2022, Oklahoma City, Oklahoma remote Trial Session and ordered petitioner to show cause in writing why this case should not be dismissed for failure to properly prosecute by February 4, 2022. On February 7, 2022, respondent filed a Status Report with the Court as to the service attempts of respondent's motion at petitioner's address of record. On February 7, 2022, the Court took respondent's Motion to Dismiss for Lack of Prosecution and the Court's Order to Show Cause under advisement. To date, no response by or on behalf of petitioner was received by the Court.
On February 28, 2022, an Entry of Appearance from Carmany Phillips was filed on behalf of petitioner. On March 10, 2022, the Court extended the time for petitioner to show cause in writing why this case should not be dismissed for failure to properly prosecute by March 21, 2022. On March 25, 2022, petitioner's counsel filed a Motion for Extension of Time was filed. After due consideration, it is
ORDERED that, on or before May 13, 2022, the parties shall submit decision documents or file a joint report with the Court as to the then present status of this case. It is further
ORDERED that petitioner's Motion for Extension of Time is granted, in that the time for petitioner to respond to respondent's motion to dismiss has been extended to May 27, 2022. 1
