JUSTICE SIMON, dissenting:

In view of the recent declaration by the United States Court of Appeals for the Ninth Circuit that Montana's intimidation statute is facially overbroad and violates the first amendment to the United States Constitution ( Wurtz v. Risley (9th Cir. 1983), 719 F.2d 1438), I would allow Carl Holder's petition for leave to appeal and reverse his conviction on the ground that Illinois' nearly identical intimidation statute (Ill. Rev. Stat. 1981, ch. 38, par. 12-6(a)(3)) is also facially overbroad and unconstitutional. See People v. Holder (1983), 96 Ill.2d 444, 454 (Goldenhersh and Simon, JJ., dissenting).
