ORDER DIRECTING SERVICE AND SCHEDULING


This complaint was filed on December 20, 2002, and on May 6, 2003, defendants Turnberry, Ltd., Pentalon Construction, Pentalon Corporation, and Pentalon Management filed an answer. To date, plaintiff has not served defendant Dale A. Allsop.

If plaintiff intends to serve Mr. Allsop, such service shall be made by May 20, 2003. Otherwise, plaintiff shall tile a voluntary dismissal of Mr. Allsop by that date. If plaintiff serves Allsop, plaintiff and the defendants who have already answered shall move forward with a scheduling conference on this matter as soon as practicable after Mr. Allsop's answer. If Mr. Allsop is not served, plaintiff and defendants who have already answered shall move forward with a scheduling conference as soon as practicable, and in any event, shall contact the magistrate judges for a conference scheduling not later than May 27, 2003.

SO ORDERED.
