MOTION
Before this court is another Motion for Default brought by DIRECTV, Inc. ("Plaintiff") against an alleged unauthorized user, in this case one Irvin Miller ("Defendant"), of it satelite signal. This court previously held a hearing with regards to plaintiff's monthly financial loss due to the illegal interception of its satellite signal and set that amount at $205.00. This court incorporates by reference its previous Report Recommendation of February 25, 2004 (case number 03 C 50220) outlining as much. In this case, Plaintiff presented account information that showed Defendant purchased illegal decoding equipment in March 2001. Plaintiff also showed that prior to March 2001, for many months, plaintiff purhcased many pay-per-view movies and the NFL Package. However, as of March 2001, Defendant failed to renew his NLF Package subscription or purchase any pay-per-view moveis and the NFL Package. However, as of March 2001, Defendant failed to renew his NLF Package subscription or purchase any pay-per-view movies. Based on this informaiton, it appears that Defendant has been using the piracy equipment for 37 months. At $205.00 a month, this court recommends a judgement be entered against Defendant in the amount of $7585.00.
