ORDER DENYING DEFENDANT FONTAINE'S MOTION FOR DISMISSAL WITH PREJUDICE


The Court heard Defendant Fontaine's Motion for Dismissal with Prejudice on April 25, 2003. Mr. Fontaine appeared pro se. Thomas R. Barton represented Plaintiff DIRECTV. Based upon the motion, the papers submitted in conjunction therewith, the arguments presented by Mr. Fontaine and Mr. Barton, and good cause appearing therefor,

IT IS HEREBY ORDERED THAT Mr. Fontaine's Motion for Dismissal with Prejudice is denied.
