In accordance with the Memorandum Ruling issued on this date, IT IS ORDERED that the motion for partial summary judgment filed by defendant Marcella Gemmell [Rec. Doc. 30] is GRANTED, and Count III of plaintiff's complaint is dismissed with prejudice.
