ORDER

It is ORDERED that the motion for leave to appeal (M-813) is granted and the matter is summarily remanded to the Appellate Division to consider on the merits. Jurisdiction is not retained; and it is further

ORDERED that the motion for a stay (M-814) is granted pending appeal in the Appellate Division. A request for a further stay must be filed before that court.
