Defendant-respondent EZ Runner Construction Corp. having moved to dismiss the appeal from the order of the Supreme Court, Bronx County, entered on or about September 21, 2016, Now, upon reading and filing the papers with respect to the motion, and due deliberation having been had thereon, It is ordered that the motion is granted to the extent of dismissing plaintiff's appeal as against EZ Runner Construction Corp. The appeal as against Kansas Fried Chicken, Inc. and ROGA remains extant.
