AND NOW, this 22nd day of September, 2011, upon consideration of Defendant Joseph T. Mancuso, III's Motion to Dismiss and Strike (Docket Nos. 10-11), Plaintiff Seth J. Diener's Response (Docket No. 14), and Defendant's Reply Brief (Docket No. 17), it is hereby ORDERED that the Motion is GRANTED WITHOUT PREJUDICE to Plaintiff's right to further amend the Complaint within twenty (20) days from the date of this Order.
