Opinion

Case No. 97-3104.

Opinion filed April 1, 1998. JANUARY TERM, A.D. 1998. Rehearing Denied May 13, 1998.

An appeal under Fla. R. App. P. 9.140(I) from the Circuit Court for Dade County, Peter R. Lopez, Judge. L.T. No. 93-22963

Paul Dicosimo, in proper person.

Robert A. Butterworth, Attorney General, and Maya S. Saxena, Assistant Attorney General, for appellee.

Before COPE, FLETCHER, and SORONDO, JJ.

Paul Dicosimo appeals an order denying his motion for postconviction relief under Florida Rule of Criminal Procedure 3.850. As the record excerpts transmitted with the trial court order do not show conclusively that the appellant is entitled to no relief, the order is reversed and the cause remanded for an evidentiary hearing. See Fla. R. App. P. 9.140(i).
