STIPULATION FOR DISMISSAL AND ORDER
On September 2, 1011, the parties reached a tentative settlement agreement in this case before the Honorable Magistrate Judge Jacqueline Scott Corley. The agreement is subject only to the final approval of the Oakland City Council. Accordingly, It is hereby stipulated and agreed by and between the parties in consultation with their respective attorneys, and by their attorneys, that this case be dismissed in its entirety with prejudice; provided, however, that if any party hereto shall certify to this Court, within ninety (90) days, with proof of service of a copy thereon to opposing counsel, that the agreed consideration for said settlement has not been delivered over, the foregoing shall Order shall stand vacated and this case shall forthwith be restored to the calendar to be set for trial.

ORDER
PURSUANT TO STIPULATION, the above captioned case is dismissed in its entirety with prejudice; provided, however, that if any party hereto shall certify to this Court, within ninety (90) days, with proof of service of a copy thereon to opposing counsel, that the agreed consideration for said settlement has not been delivered over, the foregoing Order shall stand vacated and this case shall forthwith be restored to the calendar to be set for trial. IT IS SO ORDERED.
