JOSE ANGEL DIAZ, Appellant, v. THE STATE OF TEXAS, Appellee.

Do not publish. Tex.R.App.P. 47.2(b).

ON APPEAL FROM THE 206TH DISTRICT COURT OF HIDALGO COUNTY, TEXAS

Before Chief Justice Contreras and Justices Longoria and Peña, J.

ORDER OF ABATEMENT

PER CURIAM.

This matter is before the Court upon appellee's second motion for extension of time to file its brief. Appellant filed his brief on January 24, 2024, and appellee's brief was due to be filed on March 25, 2024. Appellee has been granted one previous extension of thirty-one days.

The Court, having fully examined and considered appellee's second motion for extension of time to file the brief and the previous delays in the case, notably in obtaining the appellate record and appellant's brief, is of the opinion that, in the interest of justice, appellee's second motion for extension of time to file the brief should be granted by order.

To allow time to complete the briefing, this matter is now abated. Appellee's motion is granted, and the brief is now due to be filed on or before April 24, 2024. The matter shall be reinstated when appellee's brief is filed.
