AND NOW, in accordance with the accompanying Memorandum Opinion, IT IS HEREBY ORDERED that:

1. Petitioner Hamett Diaz's petition for writ of habeas corpus pursuant to 28 U.S.C. § 2254 is DENIED.
2. A certificate of appealability shall not issue, as Diaz has not made a substantial showing of the denial of a constitutional right.

3. The Clerk of Court is directed to mark this matter CLOSED.
